BUPPOLE 教室政策一般條款及細則
本條款及細則（「條款及細則」）構成 BUPPOLE DANCE LIMITED（「BUPPOLE」、「本公司」、「我們」）與參加者（「參加者」、「你」、「你的」）之間具有法律約束力的協議。報名參加課程（定義見下文）即表示你確認已閱讀、理解並同意受本條款及細則約束。
1. 報名、補課及缺席、及課程取消
所有課程一經確認報名，概不退還及不可轉讓。參加者必須年滿18歲，除非獲得父母或監護人同意。補課只允許安排於與原班級程度相符的班別，並必須在同一學期內完成。逾期補課將不獲安排。如需安排補課，學生必須透過報名系統於原課堂開始前至少6小時取消名額，並即時選擇替代課堂。逾期要求將不獲接納。本公司保留在特殊情況下酌情處理的權利，所有決定均為最終及具約束力。因不可控制事件（如戰爭、內亂、恐怖活動、流行病、天災、火災、罷工、政府限制或BUPPOLE控制範圍以外的其他情況）而取消的課堂，將不設補課。
2. 惡劣天氣政策
為保障參加者的安全，當場地被認為因惡劣天氣而構成危險時，BUPPOLE保留取消課堂的權利。
暴雨警告信號下的課堂安排：
- 黃色、紅色信號：所有課堂如常進行。
- 黑色信號：
- 若在課堂期間發出，下一節課堂將取消。
- 黑色信號除下後2小時內，所有課堂將恢復。
颱風警告信號下的課堂安排：
- 一號、三號颱風信號：所有課堂如常進行。
- 八號或以上颱風信號：
- 若在課堂開始前2小時內懸掛，該課堂將取消。
- 當八號或以上信號生效時，所有課堂取消。
- 八號信號除下後2小時內，所有課堂將恢復。
受惡劣天氣影響期間，BUPPOLE亦會不定時在Instagram限時動態更新課堂安排。
3. 健康與安全
為維持適當的健康及安全標準，你須在本表格上及課堂開始前向導師披露任何既往醫療或身體狀況。如對課程是否適合自己有任何疑問，請諮詢醫生。你明確承認，在BUPPOLE的照顧及監督下參與舞蹈（無論是授課形式或自由形式鋼管舞），涉及體力需求，並可能導致跌倒、扭傷、韌帶拉傷，或（對於有呼吸或心血管疾病的人士）呼吸或心血管壓力。
參加者向BUPPOLE承諾，在接受本邀請前已尋求所有適當的醫療建議，以確保身體狀況良好，完全能夠在本協議日期進行鋼管舞；此外，參加者接受並承擔因參與舞蹈而遭受的任何損失、損害、受傷或不良後果的全部責任，並就參加者在BUPPOLE或其合作地點舉辦的舞蹈課堂中受傷或身故而提出的任何索償（除非是因BUPPOLE疏忽違反謹慎責任而直接導致的損失或損害），向BUPPOLE作出賠償。參加者承認，課程導師可能需要進行一些身體接觸。
3.1 風險承擔
本人作為參加者，承認鋼管舞、空中藝術及相關體能活動涉及固有風險，包括但不限於：瘀傷、摩擦灼傷、肌肉拉傷、韌帶撕裂、骨折、腦震盪，以及極少數情況下的癱瘓或死亡。本人自願承擔所有此等風險，不論是否可預見。本人確認，BUPPOLE、其導師或代理人從未向本人作出任何安全承諾或保證。
3.2 醫療披露義務
本人確認，本人沒有任何已知會使鋼管舞變得危險的醫療狀況，包括但不限於：懷孕（或近期分娩）、心臟病、癲癇、嚴重骨質疏鬆、未受控制的高血壓、近期手術，或使用薄血藥物。本人同意，若在報名期間本人的醫療狀況有任何變化，將立即書面通知BUPPOLE。
4. 法律責任
除非直接由BUPPOLE或其員工經證實的疏忽所造成，否則BUPPOLE對任何參加者的人身傷害或死亡不承擔法律責任。
4.1 法律責任限制
在法律允許的最大範圍內，BUPPOLE就任何因課堂、直播課程或工作室使用而引起的索償，對任何參加者的總法律責任，不得超過該參加者在索償發生前6個月內向BUPPOLE支付的費用總額。在任何情況下，BUPPOLE均不對間接、後果性或特殊損害（包括收入、數據或享受的損失）承擔責任。
5. 拒絕及終止參與
如參加者持續干擾課堂秩序、患有傳染病或出現任何相關症狀（如高燒、咳嗽、流鼻涕、發燒或皮疹），或我們認為其出席影響課程或BUPPOLE的良好氣氛，本公司有權拒絕其參與課堂。BUPPOLE有權查閱參加者的香港身份證／護照正本以核實登記資料，未能提供者可能導致被拒絕參與BUPPOLE課堂。
5.1 拒絕服務、禁止進入或終會籍的權利
BUPPOLE保留即時拒絕服務、禁止進入或終止任何參加者的報名而不予退款的權利，原因包括：(a) 課堂前或課堂期間醉酒或使用藥物；(b) 對職員或學生作出騷擾、欺凌或不當言論；(c) 損壞工作室財產；(d) 盜竊；(e) 屢次遲到或無故缺席；或 (f) 任何BUPPOLE合理判斷為危害他人或干擾營運的行為。
6. 攝影及其他媒體
BUPPOLE及其業務合作夥伴／導師保留使用課堂或活動中拍攝的照片／影片作市場推廣及宣傳用途的權利。所有照片及影片只可在課堂期間拍攝，且只聚焦於自己而不可拍攝他人。學生／參加者拍攝的照片／影片僅可用於個人用途。當課堂或活動內外出現干擾時，BUPPOLE保留阻止參加者拍攝照片／影片的權利。
6.1 肖像權授權及商業用途同意書
本人授予BUPPOLE及其授權合作夥伴一項不可撤銷、永久、全球性、免版稅的許可，允許其在課堂或活動中拍攝、錄影或錄製本人。本人同意BUPPOLE在無需補償或進一步通知的情況下，將本人的肖像、影像、聲音及表演用於任何市場推廣、廣告、社交媒體、網站或宣傳材料中。本人放棄任何審閱或批准最終用途的權利。如本人不希望被拍攝，必須在課堂前書面通知BUPPOLE。
7. 直播課程
直播課程連結／會議連結嚴禁與未獲BUPPOLE邀請的人士分享。BUPPOLE的年齡政策同樣適用於直播課程。直播課程期間預期學員須遵守與實體課堂相同的恰當行為。已繳付的直播舞蹈課程費用／已確認的安排，概不退還、不可轉讓及不設積分。課程可能因任何不可控制事件（如戰爭、內亂、恐怖活動、流行病、天災、火災、罷工、政府限制或BUPPOLE控制範圍以外的其他情況）而取消，並不設補課。任何錯過的直播課程均不設補課。課程為導師單向教學，導師將決定課堂節奏，學生之間不會進行聊天。如有任何不當行為或課堂干擾，導師有權要求學生離開或終止直播平台。
所有授課導師及上課學生均可互相看見。嚴禁錄影、攝影或分享。為保障我們的參加者及BUPPOLE的利益，BUPPOLE可就任何違反私隱的行為採取法律行動。參加者必須自行評估使用Zoom應用程式進行課堂的風險，BUPPOLE對與之相關的任何損失或法律責任概不負責。
7.1 直播課程保密及預定賠償
直播課程連結、會議ID、密碼以及任何螢幕擷取、錄影或重新分發課堂內容的行為，均屬嚴格保密及BUPPOLE的專有財產。任何參加者未經書面授權而錄影、分享或允許他人觀看直播課程，每次事件須向BUPPOLE支付港幣50,000元（或等值當地貨幣）的預定賠償，以及BUPPOLE在執行本條款時產生的所有法律費用。此金額並非罰款，而是基於編舞及教學內容的專有性質而作出的合理損失估算。
8. 不保證結果
BUPPOLE僅提供指導及工作室使用權。我們不保證任何具體的健身、減重、力量或技能成果。個人成果因努力程度、出席率、身體構造及過往經驗而異。
9. 免責聲明
本文件所載的教室政策及資訊可能隨時更改，BUPPOLE恕不另行書面通知。參加者有責任不時查閱BUPPOLE的最新教室政策及資訊，最新版本將載於我們的網站（https://buppoledance.com/terms-and-conditions/）。我們保留就所有與報名及課程相關的事宜及爭議作出最終決定及解釋的權利。對於因報名、課程或活動而產生或蒙受的任何索償或法律責任，我們概不負責。
10. 管轄法律及爭議解決
本條款及細則受香港法律管轄。因本條款或你參與BUPPOLE活動而產生的任何爭議，應首先嘗試透過調解解決。若調解失敗，爭議應提交香港法院專屬管轄。集體訴訟及合併仲裁均被豁免。
11. 可分割性及不行使權利
若本條款的任何條文被認定為不可執行或無效，其餘條文應繼續完全有效。BUPPOLE在任何權利行使上的失敗或延遲，不應被視為放棄該權利。

English version – General Terms and Conditions of Studio Policy – BUPPOLE
These terms and conditions (“Terms and Conditions”) constitute a legally binding agreement between BUPPOLE DANCE LIMITED (“BUPPOLE”, “we”, “us”, “our”) and the participant (“Participants”, “you”, “your”). By registering for the classes (as defined hereunder), you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.
1. Enrollment, Catch-Up Classes & Absences, & Cancelled Classes
All classes registrations once confirmed are non-refundable and non-transferable. The participants must be 18 year-old or above unless with parental/guardian permission. Catch-up classes are only allowed for classes and levels that match the original class and must be completed within the same term. Late catch-ups will not be accommodated. To schedule a catch-up class, the student must release original class at least 6 hours in advance via the registration system and immediately select a replacement class. Late requests will not be accepted. We reserve the right to exercise discretion in exceptional cases, and all decisions made shall be final and conclusive. No catch-up class can be arranged for class cancelled due to non-controllable events like wars, civil riots, acts of terrorism, epidemics, acts of nature, fires, strikes, government restriction or other circumstances beyond BUPPOLE’s control.
2. Bad Weather Policy
In the interest of the participant’s safety, BUPPOLE reserves the right to cancel classes when a venue is deemed dangerous due to inclement weather.
Class Arrangement under Rainstorm Warning Signal:-
Under Amber, Red Signal:
All classes as usual.
Under Black Signal:
If issued during the class, the next class will be cancelled.
All classes will resume within 2 hours after Black Signal is lowered.
Class Arrangement under Typhoon Warning Signal:-
Under Typhoon Signal No.1 & No. 3:
All classes as usual.
Under Typhoon Signal No.8 or above:
If hoisted within 2 hours before class, the class will be cancelled.
When Signal No.8 or above is in force, all classes are cancelled.
All classes will resume within 2 hours after Signal No.8 is lowered.
During affected weather, BUPPOLE will update the Instagram story alert on our class status from time-to-time as well.
3. Health and Safety
In order that we maintain appropriate standards of health and safety, you are responsible for disclosing any prior medical or physical conditions on this form and also to the teacher before the class starts. If you are in any doubt as to the suitability of the course please consult your doctor. You expressly acknowledge that engagement in dance under the care and supervision of BUPPOLE in the course of tuition or as a matter of free form dance in pole dance engagement, is a physical demand and that engagement in dance may occasion falls, sprains or twisted ligaments, respiratory or cardiovascular stress (in persons with respiratory or cardiovascular disabilities).
The participants covenant with BUPPOLE that you have sought all appropriate medical advice prior to the acceptance of this invitation to ensure you in good physical condition fully able to undertake the pole dance at the date hereof and further, the participants accepts and assumes all responsibility for any loss, damage, injury or adverse consequence suffered by the participants as a result of engaging in dance and indemnifies BUPPOLE in respect of any claim by or through the participants in the event of injury to or demise of the participants as a consequence of engaging in dance class hosted in BUPPOLE or its partnering locations, excluding only loss or damage suffered as a direct consequence of negligent breach of duty of care by BUPPOLE. The participants acknowledge that some physical contact may be necessary by the course instructor.
3.1 Assumption of Risk
I, the participant, acknowledge that pole dance, aerial arts, and related physical activities involve inherent risks including but not limited to: bruising, friction burns, muscle strains, ligament tears, fractures, concussions, and in rare cases, paralysis or death. I voluntarily assume all such risks, whether foreseeable or not. I confirm that no promise or guarantee of safety has been made to me by BUPPOLE, its instructors, or agents.
3.2 Medical Disclosure Obligation
I confirm that I have no known medical condition that would make pole dance unsafe, including but not limited to: pregnancy (or recent childbirth), heart conditions, epilepsy, severe osteoporosis, uncontrolled hypertension, recent surgery, or use of blood-thinning medication. I agree to notify BUPPOLE immediately in writing if my medical status changes during my enrollment.
4. Liability
BUPPOLE does not accept liability for personal injury or death of any participants in BUPPOLE unless directly caused by the proven negligence of the company or its staff.
4.1 Limitation of Liability
To the maximum extent permitted by law, BUPPOLE’s total liability to any participant for any claim arising from classes, live streams, or studio use shall not exceed the total fees paid by that participant to BUPPOLE in the 6 months preceding the claim. Under no circumstances shall BUPPOLE be liable for indirect, consequential, or special damages (including loss of income, data, or enjoyment).
5. Exclusions and Withdrawals
If a participant is persistently disruptive, have infectious disease or with any symptoms of one (such as high temperature, cough, runny nose, fever or rash), or if we feel their attendance affects the good atmosphere of the course or BUPPOLE, we have the right to exclude them from the class. BUPPOLE has the right to examine the participants true copy of HKID/PASSPORT for verification on the registered information, failure to do so may result in the withdrawal to BUPPOLE classes.
5.1 Right to Refuse, Ban, or Terminate Membership
BUPPOLE reserves the right to immediately refuse service, ban, or terminate any participant’s registration without refund for: (a) intoxication or substance use before/during class; (b) harassment, bullying, or inappropriate comments toward staff or students; (c) damage to studio property; (d) theft; (e) repeated lateness or no-shows; or (f) any behaviour that BUPPOLE reasonably determines endangers others or disrupts operations.
6. Photography and Other Media
BUPPOLE and its business partner / teacher reserves the right to use photographs/videos taken in-class or events for marketing and promotional purposes. All photos and videos may ONLY be taken during the class, and focusing only on their own and not on the others. Photos/videos taken by the student/attendee can only be for personal use. BUPPOLE reserves the right to stop the participants from taking the photo/video when disruption to class or event occurs inside/outside the studio.
6.1 Model Release & Commercial Use Consent
I grant BUPPOLE and its authorized partners an irrevocable, perpetual, worldwide, royalty-free license to photograph, film, or record me during classes or events. I consent to the use of my likeness, image, voice, and performance in any marketing, advertising, social media, website, or promotional materials, without compensation or further notice. I waive any right to inspect or approve the final use. If I do not wish to be photographed, I must notify BUPPOLE in writing before class.
7. Live Stream Classes
Live stream class/Meeting Link is strictly prohibited from being shared with others who are not invited by BUPPOLE. BUPPOLE’s age policy also applies to live stream class. Same appropriate in-class behaviour is expected during these live stream classes. Class fees settled/arrangement confirmed for the live stream dance class are non-refundable, non-transferable nor credit. Class might be cancelled due to any non-controllable events, like wars, civil riots, acts of terrorism, epidemics, acts of nature, fires, strikes, government restriction or other circumstances beyond BUPPOLE’s control and no catch-up classes will be arranged. No catch-up classes can be arranged for any missed live stream class. The class is one-way communication by the instructor. Instructor will determine the pace of the class. No chatting will be engaged between students. Instructor will have the right to ask student to leave or end the live stream platform for any inappropriate behaviour or disturbance in the class.
All instructors and students conducting the class will be able to see each other. No video recording, photography or sharing is allowed. To protect the interest of our participants and BUPPOLE, BUPPOLE may take legal action for any breach on the privacy. Participants must evaluate the risks when using Zoom application for the session, BUPPOLE will not be responsible for any loss or liability associated with it.
7.1 Live Stream Confidentiality & Liquidated Damages
The live stream link, meeting ID, password, and any screen capture, recording, or redistribution of class content is strictly confidential and proprietary to BUPPOLE. Any participant who records, shares, or permits others to view the live stream without written authorization shall pay liquidated damages of HKD $50,000 (or equivalent local currency) per incident, plus all legal costs incurred by BUPPOLE in enforcement. This is not a penalty but a reasonable estimate of loss given the proprietary nature of choreography and instruction.
8. No Warranty on Results
BUPPOLE provides instruction and studio access only. We do not guarantee any specific fitness, weight loss, strength, or skill outcomes. Individual results vary based on effort, attendance, anatomy, and prior experience.
9. Disclaimer
The Studio Policies and Information set out are subject to change without prior written notice from BUPPOLE. It is the participants responsibility to check on the Studio Policies and Information of BUPPOLE from time to time, the latest Studio Policies and Information will be on our website (https://buppoledance.com/terms-and-conditions/). We retain the right of final decisions and interpretation in all matters and disputes in relation to the registration and programs. We shall not be responsible or liable for any claims or liability resulting from the registration, classes or programs suffered or incurred.
10. Governing Law & Dispute Resolution
These Terms and Conditions shall be governed by the laws of Hong Kong. Any dispute arising from these Terms or your participation at BUPPOLE shall first be attempted to be resolved through mediation. If mediation fails, the dispute shall be submitted to the exclusive jurisdiction of the courts of Hong Kong. Class actions and arbitration on a consolidated basis are waived.
11. Severability & No Waiver
If any provision of these Terms is found to be unenforceable or invalid, the remaining provisions shall continue in full force and effect. No failure or delay by BUPPOLE in exercising any right shall operate as a waiver thereof.
